Revision of Arbitral Awards Beyond the Model Law: "Retrial" in Arbitration?

Schoenherr expert Viktor Cserep has published a new book in Wolters Kluwer’s International Arbitration Law Library series, titled “Revision of Arbitral Awards Beyond the Model Law: ‘Retrial’ in Arbitration?”.

In it, he examines recourse against arbitral awards beyond the framework of Article 34 of the UNCITRAL Model Law. Focusing on exceptional circumstances, such as newly discovered facts, evidence, or fraud, he explores whether and how a form of “retrial” in arbitration may be possible.

Drawing on a comparative analysis of jurisdictions including Switzerland, Austria, Germany, Hungary, and England and Wales, the publication outlines different legal approaches, relevant case law, and broader policy considerations. It offers practical and theoretical insights for practitioners, academics, and policymakers interested in the evolving landscape of post-award remedies in international arbitration.
