How the U.S. shapes investigations in Europe - The latest from the U.S. Department of Justice (DOJ) on how to conduct internal investigations in order to obtain cooperation credit, third party audit rights, as well as enforcement trends.

Keep the evening of Tuesday, May 23, 2023 open. We are pleased to invite you, along with Willkie, Farr & Gallagher LLP, to discuss the DOJ's current key areas of interest with respect to internal investigations and how they impact investigations in Europe.
 
In the course of internal investigations, in addition to an analysis of the advantages and disadvantages of cooperating with U.S. authorities, a particular focus will be on the changed requirements for obtaining the so-called "cooperation bonus" resulting from the Yates Memoranda.
 
Afterwards, the increasingly stipulated "Third Party Audit Rights" will be examined in the area of conflict between (U.S.) compliance requirements and European data protection and confidentiality obligations.

Finally, we will talk about enforcement trends in the U.S. and their impact on investigations in Europe.
 
In this regard, Christoph Haid (Schönherr Rechtsanwälte), Head of Compliance and Foreign Trade at Schönherr, will exchange views with Bill Stellmach (Willkie Farr & Gallagher LLP, Washington) and Dr. Richard Roeder (Willkie Farr & Gallagher LLP, Frankfurt).
