Schoenherr advised two entities in the project related to the establishment of the joint venture behind Poland's first nationwide deposit return system (DRS).
The firm advised on key aspects of the joint venture's structure, particularly focusing on corporate governance arrangements, ensuring a solid foundation for the collaboration between the two entities involved. One entity is a Polish, family-owned company recognised for its high-quality beverages, while the other is a global private conglomerate renowned for its range of energy drinks.
The launch of Kaucja.pl marks a milestone in Poland's efforts towards a circular economy. The system aims to significantly improve the collection and recycling rates of beverage packaging, aligning with EU sustainability directives.
Kaucja.pl is a coalition of 11 beverage companies, operating with the support of the Polish Federation of Food Producers (PFPŻ).
The Schoenherr team consisted of Paweł Halwa (partner), Katarzyna Solarz-Włodarska (partner), and Krzysztof Wawrzyniak (counsel).
Osborne Clarke Poland acted as lead legal advisor in this matter.
