To meet the growing demand from our clients, we have strengthened the setup of our cross-practice and cross-office financial services litigation team. We advise banks, insurers and other financial institutions on all aspects of contentious matters, with a special focus on EU-wide litigation monitoring and strategic litigation risk management, including in consumer litigation.
Our lawyers work closely with the legal tech team to optimise efficiency through the use of cutting-edge technologies and artificial intelligence in all pertinent areas related to litigation and monitoring.
our expertise
Schoenherr's firmwide financial services litigation team represents credit institutions, insurance undertakings, funds and other financial services providers in all disputes relating to their products and services, both in domestic and transnational disputes. This includes:
- Consumer financial litigation, which will become more important due to the ECJ developing new law around Directive 93/13/EEA on unfair terms in consumer contracts.
- "Bet-the-company litigation", where we successfully represent parts of the financial services community against claims that threaten their very existence.
- Class actions, which will change significantly due to the implementation of the Representative Actions Directive (EU) 2020/1828 – for an overview of the status please see our class action info corner.
- Banking litigation, including consumer lending disputes, derivatives disputes, foreign currency lending disputes and insolvency-related disputes.
- In insurance litigation, we represent life and non-life insurance undertakings in proceedings regarding policyholder claims or claims relating to the validity of clauses as well as providing support for insurance undertakings in supervisory proceedings.
